Abstract
This thesis provides a comprehensive analysis of applying artificial intelligence technologies, as established in the Concept approved by Presidential Resolution PQ-155 of 30 April 2025, to digital forensics from the perspective of the 2023 Constitution and the Criminal Procedure Code amended by Law No. o‘RQ-1003 of 21 November 2024. The scientific novelty consists in classifying, for the first time in national jurisprudence, the seven technological directions of the Concept according to constitutional risk levels, with a legal regime proposed for each based on the new provisions of the CPC (Articles 81, 87, 88, 95¹, 204¹, 204²). Three hypotheses are tested: the inequality of constitutional risk levels of AI directions, the emergence of five constitutional conflicts from AI application, and the possibility of adapting the national legal framework by 2030. According to our analysis, Part 4 of Article 95¹ of the CPC (new edition) serves as a concrete legal anchor for establishing the regime of AI-based evidence.
